The H1B Visa Program is the primary USA work visa / work permit for professional foreign workers, in "Speciality Occupations", who want to live and work in America. The H1B visa is a non-immigrant visa category in the USA under the Immigration & Nationality Act, section 101(a)(15)(H). H1B visas are employer specific, and H1B holders can only work for the petitioning U.S. Employer (known as the 'sponsor'), and only in the H1B employment duties detailed in the application/petition. H1B workers can work for multiple US employers, but an I-129 petition must be applied for and approved by each employer. The sponsoring US employer can also place the H1B worker on the worksite of another employer if all applicable rules (e.g., Department of Labor rules) are followed - this is typically done by consulting companies who sub-contract the H1B worker to perform work for their clients or customers. An H1B visa holder can also transfer their H1B to a new employer without affecting the validity of their status - but the new H1B employer must file a new Form I-129 petition for the H1B worker. The H1B holder can start work for the new employer as soon as the transfer application is filed.
As long as the H1B employer/employee relationship exists, an H1B visa holder is still in valid status. An H1B holder can work in full or part-time employment and remain in status. An H1B visa worker can also be on vacation (holiday), sick / maternity / paternity leave, on strike, or otherwise inactive without affecting his/ her status.
H1B visa holders can bring their immediate family members (spouse, plus children under 21) to the USA under the H4 Visa category as dependents. An H4 Visa holder can stay in the USA for as long as the H1B visa holder remains in legal status. An H4 visa holder is not eligible to: 1) work in the USA, 2) obtain a Social Security number (SSN). An H4 Visa holder can attend College, and can obtain a driver's license and open a bank account while in the USA.

Green Card holders are 'Lawful Permanent Residents' of the USA, also known as an 'Immigrants'.
Green Card is the official card issued by the US government (BCIS) to foreign nationals granting them lawful permanent residency in the US. This allows you to live and work in the United States of America. It is officially called Form I-551, the Permanent Resident Card.

How to obtain a Green Card by Employer Sponsored Labor Certification.
There are 3 steps to obtaining a Green Card through Employer Sponsored Labor Certification.
This is the most common path to obtaining a Permanent Residence for foreign nationals who are in the U.S. on an H-1B visa.
Step 1: Apply for Labor Certification with the Department of Labor.
To obtain an approved Labor Certification, the employer must prove (through newspaper advertising) that they were unsuccessful in recruiting enough qualified workers for a certain position.
The employer may apply through Regular Labor Certification, or Reduction in Recruitment Labor Certification.
Regular Labor Certification processing involves filing the DOL forms ETA 750A and ETA 750B and waiting for advertising instructions from the Department of Labor.
Processing time for Regular Labor Certification varies between 1 to 3 years.
Reduction in Recruitment Labor Certification is where the employer shows the DOL that they have already UNSUCCESSFULLY attempted to recruit U.S. workers for the position. The DOL likes to see a consistent pattern of recruiting for the 6 months prior to filing, although in many cases one three consecutive day advertisement (including Sunday) in a major newspaper is sufficient. Newspaper advertising is the strongest form of evidence. Internet postings, job fairs, headhunters, etc., provide good supporting evidence.
Processing time for Reduction in Recruitment Labor Certification varies between 3 to 8 months.
Step 2: Once the employer has received an approved Labor Certification, they may apply to the INS with the Form I-140, Immigrant Petition For Alien Worker.
The foreign national may include his or her family (spouse and children) on the I-140.
Processing time for the I-140 is 3 to 8 months.
Step 3: Once the employer has received an approved I-140 petition, the next step is for the foreign national to apply for Adjustment of Status.
After the foreign national applies for Adjustment of Status, he or she (and the spouse and children) will receive work authorization and advance parole (re-entry permit after foreign travel) within 90 days. He or she will then have an interview for the Green Card in 6-36 months.
The foreign national and his or her spouse and children will receive the Green Cards (permanent residence) upon successful completion of the interview.
